Official Rules "2010 Jesse Owens Athlete of the Year Fan Vote Presented by Nike"

1. JESSE OWENS ATHLETE OF THE YEAR FAN VOTE SPONSOR: The 2010 Jesse Owens Athlete of the Year Fan Vote Presented by Nike (“Fan Vote”) is sponsored and administered by USA Track & Field, Inc., 132 East Washington St., 8th Floor, Indianapolis, Indiana 46204 ("USATF").

2. ELIGIBILITY: The Fan Vote and Sweepstakes is open to all. Employees of USA Track & Field, Inc. (USATF) or Nike and Nike International Service Association (collectively, Nike) and Nike’s parents, subsidiaries and affiliates, prize suppliers, and advertising and promotion agencies, and the immediate family members of the foregoing employees (spouse, parents, children and siblings, and their respective spouses) and individuals living in the households of each of these employees, whether or not related, are not eligible to win a prize. This Sweepstakes is void where prohibited or restricted by law, and is subject to all applicable federal, state and local laws and regulations.

BY ENTERING THIS FAN VOTE YOU ARE AGREEING TO ALL THE TERMS OF THESE OFFICIAL RULES, INCLUDING ARBITRATION OF CLAIMS IN INDIANA. IF YOU DISAGREE WITH THE TERMS OF THESE RULES, DO NOT SUBMIT AN ONLINE ENTRY FOR THIS FAN VOTE. RECEIPT OF YOUR ONLINE VOTE IS EVIDENCE OF YOUR ACCEPTANCE OF ALL TH E TERMS OF THESE OFFICIAL SWEEPSTAKES RULES.

3. HOW TO ENTER:

To enter: (a) Go to www.usatf.org/promotions/JesseOwensAwardVote/index.asp, (b) select one male and one female professional athlete that you think has had the best performances in 2010; (c) make your selections by 11:59 PM ET October 21, (d) enter your name, address, city, state, zip code, email address, phone number, date of birth, and shirt size if you would like to be eligible to win prizes and/or receive email updates about the Sweepstakes, and (e) click "submit."  Limit one (1) entry per person or valid e-mail address per day. Additional entries received from any one person or e-mail address during any one day of this Sweepstakes will be void. The name of the "authorized account holder" associated with any given e-mail address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, an online service provider, or another organization responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Proof (to Sponsor's satisfaction) of being the authorized account holder may be required by Sponsor. If a winner is a wireless service subscriber, the pertinent prize will be awarded to the primary individual named on the wireless account from which the wireless service was accessed. In the event a winning account selected is a joint account, a total of one (1) prize will be awarded in the names of the joint account holders. Sponsor is not responsible for lost, incomplete, late, damaged, or misdirected entries or email messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through www.usatf.org; miscommunications, failed computer hardware or software or telephone transmissions or technical failures, malfunction of phones (including wireless phones/handsets), phone lines, or telephone systems or other communication malfunctions, cellular equipment tower, telephone systems, wireless service problems or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Sweepstakes; printing or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise. The use of automated entry or similar devices, is prohibited and entries through such prohibited devices are void. By entering this Sweepstakes, entrants give their express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail for Sweepstakes purposes only. All entries become the property of USATF and will not be returned.

PARTICIPANT PRIZE WINNER SELECTION: Ten (10) Participant Prize Winners will be randomly selected on or about October 22 under the supervision of USATF from among all Eligible Entries received by October 21, 2010 at 11:59 PM ET.

5. ODDS: The actual odds of winning a Participant Prize will depend upon the total number of Eligible Entries received for the Sweepstakes.

6. SWEEPSTAKES PRIZES:

Ten (10) Participant Prizes: Ten (10) Participant Prize winners will be awarded a USATF/Nike item. Approximate Retail Value ("ARV"): up to $50. One of the participant prize winners will also receive a bonus Team USA jersey autographed by Carl Lewis.

7. WINNERS NOTIFICATION: The Participant Winners will be notified by email or phone with delivery confirmation and may be required to complete and sign an Affidavit of Eligibility and Liability Release, a Publicity Release, and IRS Form W-9, all of which must be returned to USATF within 14 days from prize notification date or the prize will be forfeited. Winners will receive their prizes via priority mail or UPS delivery 6-8 weeks following verification of eligibility and compliance with the terms of these rules. In the event of noncompliance with these rules or if the prize is unclaimed or the prize notification is returned as undeliverable, the prize will be forfeited and, at USATF' discretion, awarded to an alternate winner. If any of the prizes are won by an eligible individual who is not of the legal age of majority in the state of residence ("minor"), the required documents must be confirmed and signed by winner's parent or legal guardian, and the prize will be awarded in the name of his/her parent or legal guardian who will be required to fulfill all requirements imposed on the winners set forth herein. By entering the Sweepstakes, each entrant agrees to the use by USATF and its designees of the entrant’s names, cities and states of residence and photographs/likenesses for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised (including, without limitation, the Internet) without compensation, notification or permission, except where prohibited by law.

8. LIMITATION OF LIABILITY: By participating in the Sweepstakes, each entrant (or, if minors, their parents or legal guardians) agrees to release, indemnify and hold harmless USATF and Nike, and each of their respective parent companies, subsidiaries, affiliates, prize suppliers, and advertising and promotion agencies (collectively, "the Released Parties") from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize (including any travel or travel-related activity) that may be awarded. Each entrant (or, if minors, their parents or legal guardians) agrees that the laws of the state of Indiana will govern any and all disputes involving the Released Parties. Any disputes involving the Released Parties (including requests for injunctive relief) shall be resolved by arbitration before a single arbitrator, in the state of Indiana or another state selected by USATF, pursuant to the Commercial Rules of the American Arbitration Association then in force. Judgment upon any arbitration award may be entered in any court of competent jurisdiction. The Released Parties are not responsible for computer, technical, printing, typographical, human or other errors relating to or in connection with this Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or any Game related materials; or for lost, stolen, late, inaccurate, delayed, undelivered, misdirected, damaged, incomplete, garbled entries or entries that fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, human or other error; or for electronic, computer, or telephonic malfunction or error, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or from downloading or attempting to download any materials in this Sweepstakes, or inability to access any web site associated with this Sweepstakes, or any combination thereof. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of registration will be deemed to be the entrant and must comply with these rules. A potential winner may be required, at USATF’s discretion, to provide USATF with proof that the potential winner is the authorized account subscriber of the e-mail address associated with the potentially winning entry. USATF reserve the right at its sole discretion to disqualify any individual who tampers with, or is suspected of tampering with, the entry process or any aspect of the Sweepstakes, to void any entries based on USATF’s reasonable suspicion of fraud, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes. Any attempts by an individual to access any web site associated with this Sweepstakes via robotic, automatic entry devices, programs such as, but not limited to, script, macro or any other automated means, or other unauthorized entry will void all such entries by such methods. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, USATF reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law and to pursue criminal charges. As a condition of entering the Sweepstakes, entrant (or, if minors, their parents or legal guardians) agrees that:  (a) under no circumstances will entrant be permitted to seek or obtain a judgment or award of, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages; (b) all causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually in accordance with the arbitration procedures of this agreement, without resort to any form of class action; and (c) no claims, judgments or awards shall include attorneys fees. USATF reserve the right to modify the prize award procedures.

9. WINNERS LIST: For the names of the winners (available after October 28), mail a self-addressed, stamped envelope to: "Fan Vote" Online Sweepstakes Winners, 132 East Washington St, 8th Floor, Indianapolis, Indiana 46204, or access the USATF web site at www.usatf.org/promotions/JesseOwensAwardVote/index.asp by 11:59:59 PM on December 6, 2010 to view the Winners' list. Written requests must be postmarked no later than November 30 and received no later than December 6, 2010. No requests for the winners list will be honored after December 6, 2010.
